I. General
1.1. TLÜ Moodle is an open-source e-learning web application and platform located at moodle.tlu.ee (hereinafter referred to as Moodle).
1.2. The administrator of Moodle is Tallinn University (hereinafter referred to as the University), which provides Moodle as a tool for Tallinn University's lecturers and trainers to create and conduct courses and for degree and continuing education learners to participate in courses.
1.3. Moodle users (hereinafter referred to as Users) are individuals who have a Moodle user account (hereinafter referred to as an Account).
1.4. Users may only use Moodle if they agree to all Terms of Use.
1.5. Moodle usage refers to utilizing Moodle features for participation in the University’s educational activities or conducting teaching activities.
1.6. A Moodle User Account is personal, and its use requires authentication.
II. Creation and Deletion of Moodle accounts, access to courses
2.1. In Moodle, users can create an account only by using TARA authentication methods (ID-card, SmartID, MobileID). Accounts created in this way can access the environment only through TARA authentication.
2.2. For participants in partially or fully web-based continuing education courses, a Moodle account is created based on the personal data provided during course registration (first and last name, email address, personal identification number). The user receives an email with information about their Moodle username and an initial password, which the user must change upon first login.
2.3. Moodle Users are not required to provide additional data to use the learning environment. The user’s first and last name, email address, university personal registry ID number, and personal identification number (for foreign users, a code generated based on last name and date of birth) are transferred from TLÜ's user registry to Moodle. Other information (e.g., photo, city, additional names, interests) is not mandatory in the Moodle user profile and can be added by the user at their discretion.
2.4. The account of a participant in degree studies (applied higher education, bachelor's, master's, or doctoral studies, or integrated bachelor's and master's study programs) is retained in the Moodle database until the completion of their studies. Accounts become inactive after the termination of the User’s employment or academic relationship with the University.
2.5. After the deletion of TLÜ user accounts for University staff and students, their Moodle User Accounts are also deleted.
2.6. Moodle Accounts created for participation in continuing education are retained in the Moodle database as long as the User holds the role of a learner or teacher in any Moodle course.
2.6.1. Upon request, the User has the right to submit a request to the University at any time to delete their Account by sending the request to the email address moodle@tlu.ee.
2.6.2. The account and all data associated with the account in Moodle will be deleted no later than two weeks after the relevant request is received. In the event of disputes, the University has the right to keep the account for a longer period. After the account is deleted, it will no longer be possible to use Moodle. Educational results are retained in the academic information system or continuing education information system.
2.7. For degree studies, student access to the course is retained for up to 4 years if necessary, unless the account is deleted earlier. For continuing education courses, student access to the course is retained for one semester, unless the account is deleted earlier.
III. User rights, obligations, and responsibilities
3.1. A User can participate in or conduct teaching in Moodle only if TLÜ has established a relevant relationship with the User (by assigning a Role) or as a guest in a public course, if such an option has been created by the course administrator.
3.2. If the course instructor has enabled guest access to the course, it is possible to view the course as an unauthenticated user. Guest access to the course may be protected by a key. The guest has access to the course homepage information and study materials, but does not have access to forum posts, and cannot complete tests or submit assignments.
3.3. When an account is created, the User has a user profile in Moodle, where additional personal data can be saved, in addition to the information required for account creation. The User has the ability to modify and delete their added personal data at any time, except for their first and last name, personal identification number, and username. To change the name in Moodle, the User must contact Moodle support via email at moodle@tlu.ee.
3.4. The User is responsible for the accuracy of the additional personal data added to their Account.
3.5. When using the account, the User is obligated to take all necessary measures to prevent third-party access to their Account (for example, by following password creation security guidelines and logging out of the application when finished). In case of a security threat or password breach, the User must immediately notify Moodle support via email.
3.6. When creating an account and using Moodle, any activities that may damage the operation of Moodle or are in violation of laws and university regulations are prohibited. In the event of detecting prohibited activities, the University has the right to restrict the User's access to the digital learning environment.
3.7. Prohibited activities include, but are not limited to, overloading Moodle with queries, adding insecure/illegal/unethical content to the system, violating copyrights, attempting to access other Users' Accounts, or any other unacceptable behavior or assisting in such behavior by the User.
3.8. A Moodle User will receive notifications related to the use of Moodle via email. The User can disable the receipt of these notifications in their Account's messaging preferences.
IV. University's Rights, Obligations, and Responsibilities
4.1. The University has the right to use Moodle for the University’s teaching, research, and administrative purposes. The service is available 24 hours a day, 7 days a week, except during maintenance times announced by the University.
4.1.1. Maintenance windows will be applied for maintenance work, and detailed information will be provided on the Moodle homepage. During maintenance windows, the use of Moodle will be restricted or limited. Planned outages generally occur outside of working hours. If a planned outage lasts longer than 15 minutes, users will be notified about it on the Moodle homepage.
4.1.2. The University reserves the right to carry out emergency maintenance work for security reasons without prior notice.
4.2. The University is obligated to ensure that the User roles and rights are appropriate and to prevent unauthorized individuals from accessing Moodle. The course instructor is responsible for providing access to the course during the course duration.
4.3. The University has the right to integrate Moodle with the University’s information systems for the purpose of improving usability and security.
4.4. The University has the right to make unilateral changes to the terms of use, notifying Users of these changes.
4.5. Data processing and data storage take place within the territory of the European Union.
4.6. The Moodle servers, application, and database software are continuously provided with up-to-date security updates.
4.7. The University offers user support related to Moodle usage via email at moodle@tlu.ee.
4.8. The University is not responsible for the content of materials uploaded to Moodle by Users.
4.9. The University is not responsible for any malfunctions in Moodle caused by circumstances beyond its control.
V. Data Protection
5.1. The University processes personal data as the data controller solely for the purpose of enabling Users to create Accounts and to carry out teaching, research, and administrative work, in accordance with the University’s data protection conditions.
5.2. To improve and optimize Moodle’s performance, cookies are used that are stored in the web browser. To use Moodle, session cookies must be enabled, which manage the user’s login status as they navigate Moodle. If the user logs out or closes the browser, this cookie is automatically deleted from the browser and the server. Additionally, Moodle uses cookies for storing language settings and the username.
5.3. The University discloses personal data only to individuals administering Moodle, to instructors in the role of course teachers for the learners participating in their courses, and to other individuals when the requirement to disclose data arises from legal regulations. Instructors can view the first and last name, username, and email address of the learners participating in their courses.
5.4. Moodle logs User activities, which are used to track participation in courses and the completion of activities, or to resolve security incidents.
5.5. The University or a data processor authorized by the University may process all personal data contained in Moodle for the development of the educational service provided by Moodle (including the Moodle information system), for user support, or to resolve security incidents.
